Rangers arrested Gary Wayne McMillian, 54, Thursday at his west Lubbock home, according to jail records. McMillian is a captain with the Texas Department of Public Safety stationed in Lubbock and was suspended following his arrest, the agency confirmed. He began his DPS career in 2003.
A criminal complaint out of Randall County indicate McMillian is accused of inappropriately touching a family member in 2008 and 2012. However, the records do not disclose what prompted the investigation.
McMillian is charged with two counts of indecency with a child by sexual contact, DPS said. He remained in the Lubbock County Detention Center late Thursday with a bond set at $50,000.
He was released on bond the next day, according to jail records.
His conditions of bond include not having contact, direct or otherwise, with the alleged victim, her relatives or anyone younger than 17 years old. He is also prohibited from going within 200 feet of the alleged victim, her home, school or workplace.
McMillian is also prohibited from possessing a firearm as a condition of his bond.
