A former Geraldton police officer on trial accused of indecently touching and asking a 14-year-old girl for sex after meeting her on a sugar daddy app told detectives he had a problem with loneliness and used the dating app for casual sex.

Mark Kevin Swain, 50, allegedly met the 14-year-old girl through the app Sugar Daddy Meet and invited her to his home where he allegedly touched her on the inner thigh and asked her for sex.

After communicating on the app — which the teen girl joined after watching a TikTok video boasting about being paid to speak with older men — she went to Mr Swain’s Wandine home with her 14-year-old best friend in August 2022.

It is alleged Mr Swain offered to pay one of the girls $400 for sex at his home and indecently dealt with her twice.

In the Geraldton District Court on Thursday, an interview with Mr Swain and child abuse squad detectives was played to jurors, in which he admitted the 14-year-old girls, who had claimed they were adults on the app, did look underage inside his home.

“I started s….ing myself,” he said, but told police he continued through with the meeting because they were “doing something stupid” and “needed to be protected from themselves”.

“Father and policeman kicked in and I thought, ‘f….in’ hell, something needs to happen with these girls’,” he said.

At some point, after Mr Swain allegedly provided them with alcohol and propositioned one of them, the 14-year-old friend made up an excuse to leave and they ran out of the house, stealing his wallet on the way.

Mr Swain told police his first thought when they left was “thank f…”, and made plans to contact the school, police and other authorities to explain what had happened.

But the girls returned because they could not get a taxi and it was raining heavily.

Mr Swain allegedly asked one of the 14-year-old girls to stay the night, which she said she agreed to if he took her friend home. When they arrived, she made an excuse and got out of the car with her friend, the jury was told.

Mr Swain said he felt like an “absolute goose” because the girls went to his home to “pinch and run”.

“I got excited because a girl that was reportedly 19 was keen to meet me,” he said. “They wanted to come over and f…ing steal something or run their little extortion thing.”

In his interview, Mr Swain said after taking a course for post-traumatic stress disorder, he discovered he desired attention and love, and only used the “cesspit” of an app when he was feeling down.

“It’s not what I should be doing, we’re talking morality here,” he said.

He listed a number of other dating apps he used for “casual rooting” and explained he was not a “sex addict” but was lonely and had a “distorted view” he could find love on the site.

Mr Swain told police he replied “hi” to a good morning text from the girl the next day, which followed with threatening to tell his son he was a sugar daddy unless he paid her $200.

Her Swain said the only reason he followed through with the payment was because his son was bullied in school and had been critical of his previous girlfriend, who was only a few years older than him.

Mr Swain did not want his son to think “oh my god, dad’s chasing some 18-year-old again”, the court heard.

Jurors were told when the girls told his son regardless, Mr Swain’s first thought was “you vicious little cow” and he contacted the school and texted his officer-in-charge to explain the situation.

During the 14-year-old friend’s evidence on Tuesday, she said Mr Swain introduced himself with the fake name John, shortly after paying for the girls’ taxi fare.

While they were in the lounge room, the 14-year-old said she filmed parts of a conversation between Mr Swain and the alleged victim to “capture evidence” in case something went wrong.

In the videos, the 14-year-old is heard saying: “I’ve done a few things” and “I don’t know, just like, normal stuff”.

The friend told the court Mr Swain had asked her how many men she had been with and what sex position she liked, but there was no recorded evidence of that.

The jury heard Mr Swain messaged the 14-year-old the following day, while she was at school, telling her he knew her friend stole the wallet but it would all go away if she met up with him again.

Her friend told the court she screamed at him on a Snapchat call, telling him what he was doing was “blackmail” and “glorified prostitution”, but she could not recall threatening to tell his son of his use of the app.

The friend filmed the 14-year-old getting out of Mr Swain’s car at a public carpark after she received $200.

She said she recorded the video because she was “being sneaky, sly” or in case she needed it for evidence if he went to police over the stolen wallet.

Mr Swain has pleaded not guilty to two counts of indecent dealing with a child and encouraging a child to engage in sexual behaviour.

The trial continues.
